3. Account Registration

5. Candidate Data and Responsibilities

When using our Service to collect and process candidate data, you acknowledge and agree that:

• You are the data controller for candidate information collected through your job listings
• You are responsible for ensuring your use of candidate data complies with applicable privacy and employment laws
• You will obtain appropriate consent from candidates before collecting their information
• You will not use candidate data for purposes other than evaluating them for employment
• You will handle candidate data securely and in accordance with your own privacy policy

6. AI Features and Limitations

Our Service includes AI-powered features for candidate screening and recommendations. By using these features, you acknowledge that:

• AI recommendations are intended as decision-support tools and should not be the sole basis for hiring decisions
• You are responsible for reviewing and making final hiring decisions
• AI outputs may contain errors or biases, and you should exercise human judgment
• We continuously work to improve AI accuracy and reduce bias, but cannot guarantee perfect results
• Your use of AI features must comply with applicable laws regarding automated decision-making in employment

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SLCT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

8. Payment Terms

Certain features of the Service may require payment. By subscribing to a paid plan, you agree to:

• Pay all applicable fees as described at the time of purchase

• Authorize us to charge your payment method on a recurring basis

Fees are non-refundable except as required by law or as explicitly stated in these Terms. We may change our fees upon reasonable notice. Continued use after price changes constitutes acceptance of new pricing.

9. Termination

You may terminate your account at any time by contacting us or using account settings. We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users or us, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will cease immediately. You may request export of your data within 30 days of termination.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected. We do not guarantee any specific results from use of the Service or AI features.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLCT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your content
• AI recommendations or outputs
• Any hiring decisions made using the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless SLCT and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
